Is It Legal For Non-married Couples (1 Male, 1 Female) To Live Together In Dubai?

Sharia Regulation in Dubai and how it impacts you

You might be sharing an condo with a buddy of the opposite sex. And also the arrangement might be innocent, strictly for financial factors. But within the eyes of Sharia regulation you are committing an offence. A lot more and a lot more people are getting punished because they state they were unaware of the regulation and its clauses.

There are hundreds of instances this kind of as these that emerge every year possibly from the police or the courts. An increasing quantity of men and women, who are not blood relatives nor legally married, and have contributed a flat, room or even sat in tinted cars, are being jailed and deported, a lawyer mentioned. These women and men have shared no relationship.

Dr Adel Khamis Al Mimari from Al Itazan Consultant and Advocates said they are getting punished in accordance with Sharia law. The clause is known as “Tawajed” or “Tahseen Al Ma’asiya”. These couples are already punished under this clause: sharing a closed place and encouraging sin even although they shared no relationship.

He pointed out: “The bottom line is attention. Many foreigners are not acquainted with Sharia regulation and therefore they are punished. If these couples go unnoticed, then there is no trouble. But when the authorities for some cause or an additional know they’re sharing a ‘closed space’ they can be punished. This really is the law.”

All about regard

“These couples think they’re leading a normal life, like they would within their home nations. But this really is regarded a sin right here. Filipino nationals top the record of nationalities who fall into this trap adopted by Indians, Europeans and Chinese. People should be educated about this issue to avoid problems.”

Dr Ahmad Al Qubaisi, a primary Islamic scholar, informed that every country has its lifestyle and traditions. Every country should respect others.

“Westerners respect each other and they know their countries’ traditions and laws. So why when it comes to Muslims they claim which they don’t know something about the traditions and culture? The West understands well that Muslims, like Hindus, Christians and Jews, have their culture and traditions. They should regard our religion,” Dr Al Qubaisi said.

The custom

“Our tradition is against a man and lady, who aren’t lawfully related, mingling privately or being in a closed place on your own, while within the West they are able to have a sexual relationship even though they aren’t betrothed. Our traditions are really various,” Dr Al Qubaisi mentioned.

“We see numerous such cases of foreign women and men in courts. They say they don’t know the traditions and religion here. They should know and regard our custom exactly the same way we regard their custom and religion,” he said.

The sentence

Dr Khalifa Rashid Al Sha’ali, Dean of the Faculty of Regulation at Ajman University, said if a guy and a woman who are not related are caught alone in a exclusive place, they face a jail sentence or lashes even if they were not involved in any suspicious act. It is up to the judge’s discretion to decide whether they should be deported.

Dr Al Sha’ali, a previous Ajman Police Chief, informed that during his tenure, he dealt with several this kind of instances.

Mohammad Yousuf, Deputy Director of the Dubai Courts Department, mentioned while the Federal punitive law is implemented in the UAE, the scenario is different in Dubai. The Tawajed or Tahseen Al Ma’asiya clause, he said, isn’t implemented in Dubai.

Sultan Khalifa Bin Bakheet Al Matroushi, Chairman of the Ajman Federal Appeal Court, said if a man and woman are sitting alone within the work location or in front of people, they will not be charged. If they’re discovered inside a bedroom or in a home or vehicle and the circumstances are suspicious, they will face charges even though they’ve not committed adultery. The couple can also be deported, he said.

Justice minister explains the regulation

Mohammad Bin Nakhira Al Daheri, Minister of Justice, informed that according to Sharia, if a man and lady are discovered inside a closed location alone they may get arrested, but he gave an assurance that they’re held for great cause. He stressed how the police would investigate very first.

“If a couple is discovered on your own in a closed location such like a home, space or vehicle they might encounter legal action. There also should be a complaint against them. Nevertheless, if their actions aren’t against public morals such as being in their function location or within a lift, of course no motion will be taken. If police obtain a tip that a guy and lady are in a closed location, they’ll investigate and if they aren’t performing something towards the law they will not be punished.

“There must be a complaint and investigation from law enforcement. The public prosecution and also the judge can choose if something illegal was going on,” Al Daheri mentioned.

What the people say

Kristina from Macedonia may be residing in the UAE for the last six months. She said she has no idea about Sharia law or even the clause, which prohibits women and men, who are not blood relatives nor lawfully married, from discussing a flat, room or even seated in tinted vehicles. “People must have privacy. It’s strange that a neighbour or a watchman can phone the police if two people are inside a private location alone. Why do not individuals call the law enforcement once they hear somebody beating up his wife at home? Many of us right here aren’t Muslims. We regard Islam and also the traditions of the land. Therefore, our method of life should also be respected.” She said it’s the duty of businesses who employ people from abroad to create them aware about Sharia. “This regulation doesn’t exist in my nation, wherever it is normal to become together with your boyfriend on your own inside a closed location. I believe if companies alert individuals prior to they come right here, it’ll assist them.”

Mohammad Elias from India is in his 20s and never married. He may be within the UAE for two months, but says he has never heard concerning the clause. “I might not agree using the clause, but I do respect the law of the land here, and I think foreigners should adhere towards the law,” he said.

Tess Yema in the Philippines functions as a teacher inside a school in Sharjah and has been right here since August. “I am aware of the law. I possess a brother-in-law who has been within the UAE for many many years. He told me concerning the clause. Prior to coming towards the UAE, the authorities in my country told me about Sharia. I realized these aspects very nicely before coming here. I respect the law on this country and I regard their method of thinking even though it is various from the a single in my nation,” Yema mentioned. “I was even informed about the dress code here. I knew that if I offended the regulation I would encounter punishment,” she mentioned.

Samer Assaf is married with two daughters. His loved ones is within Syria. “I have been living here for a lot more than 15 many years, but I have in no way noticed about this clause, not in my country and not here. I’m a Christian, but I respect the traditions and customs of others.”

Lucia Alinea from the Philippines, may be within the UAE for a few weeks only, but she is nicely conscious of the clause. “My brother may be here for numerous years and he is aware of the Sharia regulation. “I tried to learn as much concerning the customs and traditions right here before leaving the Philippines. We have to respect the law right here or anywhere,” said Lucia, who is a teacher inside a private college in Sharjah.

The main purchaser is allowed to apply for a 3 year residency permit when purchasing certain properties. Not all properties have this eligibility and hence clarification should be sought before purchase. A resident’s visa does not entitle the holder to work. The main purchaser may re-apply for residency every 3 years indefinitely as long as the applicant is still a property owner and has not breached any Dubai regulations. The cost of a residency application is about £1000. This may vary between developers. There will also be an administration charge to arrange. The main purchaser may then sponsor the rest of his FAMILY. The number of bedrooms in the property will determine how many resident permits may be allowed. Properties may be purchased jointly by a husband or WIFE but a main purchaser must be designated and the principle purchaser only will be allowed to apply for the residency visa. Once the principle purchaser has a residency visa then he/she will be allowed to sponsor other immediate family members. They will not be allowed to sponsor friends or PARTNERS. A resident will be required to enter Dubai at least once every six months, for his visa to remain valid.
In the UAE it is illegal for a non married couple to live together also when the authorities only react on complaints. Only one of you would be able to obtain a residence visa by buying property. (Mostly the man/husband) You will not be able to sponsor your girlfriend.
